Description/Abstract: 

municipalities, owners, and contractors often struggle to effectively manage their construction projects and remain in compliance with the construction general permit. the way that construction contract and bid documents are structured can result in a project that create a collaborative environment between project owners/municipalities and contractors to ensure that the project is in compliance with the cgp and remains within budget and on schedule. alternatively bid documents and contracts that are poorly written, and ambiguous when it comes to roles and responsibilities for bmp installation, maintenance and cgp compliance can lead to major conflict, claims, cost overruns, and potential for cgp violations and fines. this presentation will focus on pre bid strategies and construction bid document language, quantities, and pricing for bmp installation, implementation and cgp compliance.

the focus of the session will be the following:
1. common stormwater compliance contract language ambiguities. construction bid documents with and without clear methods of payment in contract documents.
2. unit price vs. lump sum pricing with schedule of values
3. pre construction design and takeoffs to allow for unit price bids of bmp installation and maintenance.
4. swppp writing, notice of intent, permit payment responsibility
5. notice of termination responsibility language and methods of achieving final stabilization.
at the conclusion of the presentation the presentors will allow for five to ten minutes of q and a.

Bob Shults is a professional civil engineer, QSD, and co-owner of Verux, Inc. Verux, in existence since January 2010, is a consulting firm based in Sacramento, which specializes in stormwater consulting and construction management. Bob's 20+ year career includes work as a geotechnical engineer for a local Sacramento firm, construction manager and estimator for a large general infrastructure construction company, project and construction manager for major land development and municipal projects, and specialization in stormwater compliance consulting, including SWPPP writing and inspections for the past seven years. Bob currently leads the stormwater compliance unit at Verux.

Ben Rau is a Class A general contractor, QSD, and co-owner of Verux, Inc. Verux, in existence since January 2010, is a consulting firm based in Sacramento, which specializes in stormwater consulting and construction management. Ben's 19+ year career includes work as a construction manager and estimator for a large general infrastructure construction company, project and construction manager for major land development and municipal projects, and specialization in stormwater compliance consulting, including SWPPP writing and inspections for the past seven years. Ben is currently managing a 50+ million dollar land development project for Verux.
